Notice of Violation

On November 23, 2015, SCAQMD issued Notice of Violation P62646 to SoCalGas for creating a Public Nuisance in violation of California Health and Safety Code Section 41700Link to external website. and SCAQMD Rule 402 - Nuisance.  The notice of violation cited SoCalGas for daily nuisance violations beginning October 23, 2015 and continuing each day until odors from the leak no longer contribute to a public nuisance. The notice of violation also directed SoCalGas to expeditiously and safely stop the leak and expeditiously abate the release of air contaminants that are causing the public nuisance. State law authorizes the SCAQMD to collect civil penalties at various levels, according to proof, of between $1000 per day and $1,000,000 per day for air pollution violations. The penalty level that is appropriate for the nuisance violations caused by SoCalGas will be determined following the SCAQMD’s investigation of the facts and circumstances surrounding the natural gas leak.
